PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the first respondent to dispose of the patta transfer appeal pending in Na.Ka.A6/7385/2023, on the file of the first respondent, within the time frame that may be stipulated by this Court.

ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the first respondent to dispose of the patta transfer appeal pending in Na.Ka.A6/7385/2023, on the file of the first respondent, within the time frame that may be stipulated by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the third respondent, notice to the third respondent is hereby dispensed with.

4. The learned counsel appearing for the petitioner would submit that the petitioner is the lawful owner of the property in Survey No.647/5, measuring an extent of 0.85.50 Hectares (2 Acres and 11 Cents), situated at Mavathur Revenue Village, Kadavoor Taluk, Karur District. However, during UDR survey, the subject property was wrongly recorded in the name of the third respondent herein. Hence, the petitioner submitted a representation dated 30.11.2023 requesting to rectify the mistake and to restore the petitioner's name in the revenue records, but no action has been taken by the first respondent. Hence, the present Writ Petition.

5. The learned Government Advocate appearing for the official respondents would submit that, in the present case, the District Revenue Officer, Karur District, is the competent authority to consider the grievance raised by the petitioner.

6. In view of the above, this Court suo motu impleads the District Revenue Officer, Karur District, as the fourth respondent in the present writ petition. 7. Considering the above submissions, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the petitioner to file an application along with all the necessary documents before the fourth respondent within a period of two weeks from the date of receipt of a copy of this order. In the event of filing a fresh application along with the necessary documents within the aforesaid time limit, the same shall be considered and disposed of by the fourth respondent on merits and in accordance with law, after affording due opportunity to all parties concerned, within a period of fourteen weeks thereafter. No costs.
