PRAYER :- Writ Petition filed under article 226 of the Constitution of

India to issue a Writ of Mandamus to direct the respondents herein not to

harass or interfere with the lawful functioning and management of

Arputham Sports and Recreation Club, Madurai South and on basis of

the petitioner representation dated 21.01.2026.

This Writ Petition has been filed for issuance of a Writ of

Mandamus directing the respondents herein not to harass or interfere

with the lawful functioning and management of Arputham Sports and

Recreation Club, Madurai South, based on the petitioner’s representation

dated 21.01.2026.

2. Mr. A.S. Abul Kalaam Azad, learned Government

Advocate (Criminal Side), takes notice for the respondents.

3. The petitioner is running Arputham Sports and Recreation

Club, Madurai South. The allegation against the respondents is that they

are harassing the petitioner and interfering with the lawful functioning

and management of the said club. The petitioner is having a valid licence,

and standard operating procedures have also been prescribed. One such

condition is that the members should possess identity cards and enter the

club after signing the entry register. Further, there should be CCTV

coverage and gambling is prohibited, along with other conditions. In

spite of the same, the respondents are allegedly harassing the petitioner.

4. The learned Government Advocate (Crl. side) appearing for the

respondents, however, submitted that the petitioner was running the same

club under a different name, viz., Dream Recreation Club, Madurai

South, and that seven FIRs have been registered against the petitioner.

Therefore, the present petition cannot be entertained.

5. This Court is of the considered opinion that when standard

operating procedures and conditions are prescribed under the licence, the

petitioner should be permitted to carry on lawful activities. Only in the

event of violation of the conditions, the respondents are entitled to take

action. It is submitted by the respondents that the petitioner is not

providing necessary documents. For such reasons alone, the respondents

cannot interfere with the club activities. However, the petitioner is bound

to furnish all necessary particulars, especially CCTV footage and other

relevant documents. Therefore, whenever the respondents seek such

particulars, the petitioner shall provide the same, otherwise, the

respondents shall not harass or interfere with the petitioner beyond the

conditions and standard operating procedures prescribed in the licence.

6. With the above observations, this Writ Petition is disposed of.
