PRAYER :- Writ Petition, filed under Article 226 of the Constitution of
India, praying this court to issue a Writ of Certiorarified Mandamus to
call for the records relating to impugned Check Slip passed by the 2nd
respondent in Refusal Number RFL/Melapalayam/23/2026 dated
19.01.2026 and quash the same and consequently direct the 2nd
respondent to register the settlement deed executed by the petitioner
dated 12.01.2026.

ORDER
This writ petition has been filed challenging the impugned refusal
check slip of the 2nd respondent in Refusal Number
RFL/Melapalayam/23/2026 dated 19.01.2026 and for a consequential
direction to the 2nd respondent to register the settlement deed executed by
the petitioner dated 12.01.2026.
2. Heard the learned counsel for the petitioner and the learned
Special Government Pleader for the respondents. By consent of both
sides, the writ petition itself is taken up for final disposal at the
admission stage itself.
3. The petitioner's father possessed the land in question and after
his demise, the property devolved upon the petitioner, as he is the sole
legal heir. When the petitioner has become the owner of the property, he

intends to settle the property in favour of his wife. However, when the
settlement deed was presented for registration, the same was refused to
be registered by referring to Section 22A of the Registration Act.
4. The learned Special Government Pleader fairly submits that in
the refusal check slip, no reason has been assigned and hence, the matter
may be remanded back to the 2nd respondent for considering afresh.
5. I have considered the rival submissions and perused the
materials available on record.
6. As rightly contended by the learned counsel on either side,
though the 2nd respondent referred Section 22A of the said Act, no reason
has been assigned for non registration. It is not in dispute that the
petitioner, as legal heir, has acquired the property in question after the
demise of his father and as on date, he is the lawful owner of the
property. In such an event, there is no impediment for the 2nd respondent
to register the settlement deed. Hence, the impugned order of refusal
check slip is set aside.

7. Hence, while remanding the matter back to the 2nd respondent,
the petitioner is directed to represent the settlement deed dated
12.01.2026 and in the event of such representation, the 2nd respondent
shall register the same forthwith.
8. The writ petition stands disposed of accordingly. No costs.
