PRAYER: Writ Petition filed under Article 226 of the Constitution
of India, praying this Court to issue a Writ of Mandamus
directing the respondents to exempt the Petitioner from paying
the tender amount of a sum of Rs.6,63,000/- for the tender period
from 2021 to 2022 in view of the second lock down due to
Covid-19 pandemic crisis on the basis of Petitioner’s
representation, dated 8.3.2022.

This Writ Petition has been filed seeking issuance of a Writ

##PAGE2##of Mandamus directing the respondents to exempt the Petitioner
from paying the tender amount of Rs.6,63,000/- for the tender
period from 2021 to 2022 in view of the second lock down due to
Covid-19 pandemic crisis, on the basis of Petitioner’s
representation, dated 8.3.2022.
2.The learned counsel for the respondent brought to the
notice of this Court that the Petitioner’s representation was
considered in the light G.O(D) No.337, Municipal Administration
and Water Supply Department(MA.IV) Department, dated
16.6.2023 stating that orders were passed. Para 8 of the common
counter filed by the respondent reads as follows:
‘’8.It is further submitted that the Petitioner(Karuppaiah) has
paid the annual lease amount for the period 2021-2022, 2022-2023. As
far as payment of lease for annual year 2023-2024 is concerned, this
respondent has deducted a sum of Rs.,1,10.500/-(during the period
1.5.2021 to 31.6.2021)/Second Wave period) and thereafter the
Petitioner has paid a sum of Rs.6,22,457/- out of the amount of Rs.
7,32,957/- Hence this respondent has extended waiver benefits during
Covid-19 period by following the above said Government Order in letter
and spirit. The petitioner also duly accepted the same and here are no
arrears payable by him in respect of the petitioner namely Karuppaiah in
W.P(MD)No.7161 of 2022.As far as the said Writ Petition becomes
infructuous.’’

##PAGE3##3.In view of the above said facts, the Petitioner’s request for
exemption has been considered by the respondent Municipality
and as such, no further orders are called for from this Court.
4.With the above observation, the Writ Petition stands
disposed of. No costs.
