PRAYER: Writ Petition filed under Article 226 of the Constitution
of India, praying this Court to issue a Writ of Mandamus
directing the respondents to exempt the Petitioner from paying
the tender amount of a sum of Rs.5,25,165/- for the tender period
from 2020 to 2021 as the bus stand remained closed due to
Covid-19 pandemic crisis on the basis of Petitioner’s
representation, dated 4.3.2022.

The present Writ Petition has been filed seeking issuance of

##PAGE2##a Writ of Mandamus directing the respondents to exempt the
Petitioner from paying the tender amount of Rs.5,25,165/- for the
tender period from 2020 to 2021 as the bus stand remained closed
due to Covid-19 pandemic crisis on the basis of Petitioner’s
representation, dated 4.3.2022.
2.The learned counsel for the respondent submitted that the
representation of the Petitioner has been considered in the light
G.O(D) No.337, Municipal Administration and Water Supply
Department(MA.IV) Department, dated 16.06.2023 and the
benefits have already been conferred on the Writ Petitioner. Para
12 of the counter filed by the respondent reads as follows:
‘’8.It is further submitted that the Petitioner has paid the annual
lease amount for the period 2018-2019, 2019-2020.As far as payment of
lease for annual year 2020-2021 is concerned, this respondent has
deducted a sum of Rs.1,19,085/-(period from 1.6.2020 to
31.8.2020(first wave period) and thereafter the Petitioner has paid a
sum of Rs.1,43,996/- out of the amount of Rs.5,25,165/-.Hence this
respondent has extended waiver benefits during covid-19 period by
following the above said Government Order in letter and spirit in
respect of the Petitioner namely Meiyanathan in W.P(MD)No.7201 of
2022. It is pertinent to mention that the Petitioner Meiyanathan in
W.P(MD)No7201 of 2022 is concerned, this respondent has given
benefit of covid 19 waiver and accordingly waived a sum of .1,19,085/-.
But the Petitioner Meiyanathan has paid only a sum of Rs.1,43,996/-
and he has to pay a sum of Rs.2,62,169/-.This amount has not paid till
date by the Petitioner (V.Meiyanathan).’’

##PAGE3##3.In view of the above said facts, the Petitioner’s request for
exemption has been considered by the respondent Municipality
and order has been passed by the respondent/Municipality.
4.Recording the above said facts, the Writ Petition stands
closed. No costs.
