Prayer: Writ Petition filed under Article 226 of the Constitution of India for the

issuance of Writ of Mandamus, directing the first respondent Collector to act

upon the petitioner’s complaint dated 06.10.2025 and take appropriate action

under the Senior citizen Act.

ORDER

The prayer in the writ petition is to take appropriate action on the

petitioner’s complaint dated 06.10.2025 under the Maintenance and Welfare of

Parents and Senior Citizens Act, 2007.

2. Upon perusing the material records of the case, the grievance of the

petitioner appears to be that her mother is in the custody of her brother and

sister-in-law. Firstly, it is stated that they are abusing the mother of the

petitioner. Secondly, visiting rights are prayed by the petitioner.

3. It can be seen that the senior citizen concerned has not lodged any

complaint. If the petitioner wants visiting rights or any other relief with

reference to her mother, she has to approach the appropriate Civil Court in the

manner known to law and the same cannot be granted under the Maintenance

and Welfare of Parents and Senior Citizens Act, 2007.

4. The Act only envisages that if a senior citizen is not maintained or not

treated with dignity, relief can be granted. In the absence of any complaint from

the senior citizen, the petition from the petitioner cannot be entertained.

5. Accordingly, finding no merits and granting liberty to the petitioner to

approach the appropriate forum, the writ petition stands disposed of. No costs.
