Murugan Respondents PRAYER Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 2^nd Respondent to conduct detailed enquiry on petitioner’s representation dated 21.05.2024 and rectify the defect in the legal heirship certificate issued in TN-720220329118 by including the petitioners mother’s name B.Kuppammal and the petitioner’s name B.Devarajan in the legal heirship certificate of petitioner’s father within a reasonable time.

For Petitioner: Mr.G.Sudangan For Respondent: Mr.R.Neelakandan, Additional Advocate General Assisted by Mr.Yogesh Kannadasan, Special Government Pleader for R1 to R3 ORDER This writ petition has been filed seeking a direction the 2^nd Respondent to conduct detailed enquiry on petitioner’s representation dated 21.05.2024 and rectify the defect in the legal heirship certificate issued in TN-720220329118 by including the petitioners mother’s name B.Kuppammal and the petitioner’s name B.Devarajan in the legal heirship certificate of petitioner’s father within a reasonable time.

It is the case of the petitioner that his father viz., Balan (deceased) had two wives and the petitioner was born through the first wife B.Kuppammal and the respondents 3 to 7 born through the second wife. After the demise of his father in the year 1996, the petitioner applied for a legal heirship certificate on 28.03.2022. Subsequently, the respondents 4 to 7 have also applied for a legal heirship certificate on 04.04.2022 and got the legal heirship certificate in the year 2022 suppressing the fact of first marriage of his father. It is the grievance of the petitioner that the 3^rd respondent without conducting proper enquiry, has issued the legal heirship certificate to the respondents 4 to 7 by omitting the names of the petitioner and his mother. Hence, he made a representation dated 21.05.2024 to the 2^nd respondent requesting to rectify the defects in the legal heirship certificate. However, the same has not been considered till date.

Hence, this petition.

3. Heard the learned counsel on either side and perused the materials available on record.

Considering the limited relief sought by the petitioner and the fact that the representation is pending for more than a year, this Court directs the 2^nd respondent to consider the representation of the petitioner 21.05.2024 after affording an opportunity of personal hearing to the petitioner as well as the interested parties and pass appropriate orders on merits and in accordance with law, within a period of three weeks from the date of receipt of a copy of this order.

5. With the above direction, this writ petition stands disposed of. No costs.
