PRAYER: The Original Petition has been filed under Section 373 of the Indian Succession Act read with Order XXV Rule 6 of the High Court Original Side Rules praying that a Succession Certificate may be granted to the petitioner with the power to collect the debts and to receive the interest specified in the schedule hereto.

ORDER
This petition has been filed by the petitioner praying to grant Succession Certificate under Section 372 of the Indian Succession Act read with Order XXV Rule 6 of the Original Side Rules.
2. According to the petitioner, he had been living with his sister namely C.R. Sumana and she died 23.01.2025, as a spinster. The father and mother of the deceased C.R. Sumana predeceased her on 25.01.1972 and 10.06.2020 respectively. The deceased C.R. sumana died intestate leaving behind the petitioner as her surviving legal heir. The deceased, during her life time, had maintained various savings accounts and the succession certificate is required to the petitioner for claiming the proceeds of the deposits at Savings Account, recurring account, fixed deposit account and Public Provident Fund account at department of posts, besides National Savings Scheme of the deceased from the Choolaimedu Post Office and the credit balance in the Indian Overseas Bank, Anna Nagar, Chennai. The value of the said assets is approximately at Rs.31,15,444.01. The petitioner, as the only legal heir of the deceased, claims to be entitled to the estate. There is no other next of kin other than the petitioner. Since the petitioner is the only legal heir of the assets of the deceased and in order to get those shares, the Succession Certificate is necessary to him. In spite of due and diligent search, no will was found to be executed by the deceased. Therefore, the petitioner has filed this petition to grant succession certificate in his favour.
3. After filing of this Original Petition, the petitioner was directed to effect paper publication and the same was also effected. No any objection was received from any party. Thereafter, the matter was posted for examination of witnesses and the evidence was recorded. On the side of the petitioners, they examined PW1 and marked Ex.P.1 to Ex.P17.
4. This Court also perused the entire documents including the evidences.
The petitioner herein has been examined as PW1 and Ex.P.1 to Ex.P.17 were marked. On a careful perusal of the evidence of PW1 and the documents Ex.P.1 to Ex.P17, they reveal that the petitioner is the legal heir of the deceased Miss. C.R. sumana and the deceased had maintained some savings accounts and other accounts mentioned in the Schedule of the petition and she died intestate, thereby, her legal heir is entitled to get the those proceeds and therefore, petitioner is entitled to the Succession Certificate.
5. In view of the same, this Original Petition is allowed. The petitioner is entitled to the value of the assets and a direction for grant of Succession Certificate in favour of the petitioner with power to collect the securities and to receive the interest and dividends on and negotiate and transfer the securities specified in the Schedule, as applicable till the date of withdrawal, is issued.
