ORDER

This Writ Petition has been filed challenging the memo dated

15.01.2021 and the order dated 16.04.2021 passed by the third respondent and consequently to direct the respondents to reinstate the Petitioner into service with continuity of service, back wages, all service, monetary and other attendant benefits within a time frame to be fixed by this Court.

2. The learned counsel appearing for the petitioner would submit that the petitioner had joined as Constable in Central Industrial Security Force (in short ‘CISF”) in the year 2013 and posed at IG Mint, Hyderabad. While he was in service, he was issued with a charge memo dated 15.01.2021 by the third respondent in which, the petitioner participated in the enquiry and the respondents passed a final order dated 16.04.2021, by imposing the punishment of reduction of pay by two stages from Rs.27,600/- to 26,000/- in time scale of pay of Rs.21,700 – 69,100/- (level-3) for a period of one year. Challenging the same, the present Writ Petition is filed.

However, the learned Special Panel Counsel appearing for the respondents would submit that as against the order impugned, there is an effective appeal remedy is available before the Deputy Inspector General, CISF viz., the second respondent herein and hence this Court may direct the petitioner to file an appeal before the second respondent.

4. Heard the submissions made by learned counsel on either side and perused the materials available on record.

5. Since there is an effective appeal remedy is available before the Deputy Inspector General, CISF viz., the second respondent herein, this Court permits the petitioner to file an appeal before the second respondent and the period pending before this is excluded for the purpose of limitation.

6. With the aforesaid directions, the Writ Petition stands disposed of.

Consequently, connected miscellaneous petition is closed. No costs.
