O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first to third respondents to cancel Patta No.132 by considering the petitioner’s representation dated 19.07.2025 and to restore the patta to its original status and further to initiate appropriate action against the fifth to seventh respondents for creating fraudulent documents and manipulating the revenue records on the strength of forged documents, within a time frame to be fixed by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to the fifth to seventh respondents, as no adverse orders are proposed to be passed against them.

The grievance of the petitioner is that the first to seventh respondents, in collusion with others, have fraudulently obtained Patta No.132 in respect of the subject property and on the strength of the same, the seventh respondent executed a Sale Deed in favour of the fifth and sixth respondents. Though the petitioner submitted a detailed representation dated 19.07.2025 to the first to third respondents seeking cancellation of the patta fraudulently obtained and initiation of action against the fifth to seventh respondents for creating fraudulent documents and manipulating the revenue records on the strength of forged documents, no enquiry has been conducted and no action has been taken on the said representation. Therefore, the petitioner has been constrained to file the present Writ Petition.

The learned Additional Government Pleader appearing for the first to third respondents, on instructions, submits that the petitioner’s representation dated 19.07.2025 would be considered and appropriate orders would be passed by the third respondent, after affording an opportunity of hearing to the fifth to seventh respondents, within a period of twelve weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the third respondent to consider the petitioner’s representation dated 19.07.2025 and pass appropriate orders, after taking into consideration all the objections raised by the fifth to seventh respondents, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. The said representation shall be disposed of after conducting an enquiry. The third respondent is also directed to afford a reasonable opportunity of hearing to the petitioner, the fifth to seventh respondents and any other interested parties who may be affected by such decision, before passing any order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. There shall be no order as to costs.
