...Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the 1st respondent to consider and pass orders on the Appeal dated 25.11.2025 preferred by the petitioner for reimbursement of medical claim of Rs.2,15,803/- incurred by the petitioner towards the treatment of right leg cellulites with blebs of petitioner's husband from 24.07.2019 to 12.08.2019 in Aysha Hospitals Private Limited, Kilpauk, Chennai 600 010 under Tamil Nadu Government Medical Attendance Rules in terms of G.O.Ms.No.401, Health and Family Welfare (Z1) Department dated 09.09.2021, within the period that may be stipulated by this Court.

ORDER

The petitioner is a pensioner covered under the Tamil Nadu New Health Insurance Scheme for pensioners. Her husband underwent treatment in a non-network hospital for amputation in his right leg on 24.07.2019 and he was discharged on 12.08.2019 from the hospital. The petitioner has incurred a sum of Rs.2,15,803/- towards the medical treatment and therefore, she has submitted a representation for reimbursement of the medical expense. However, the representation was rejected by the 5th respondent that the illness suffered by the petitioner's husband is not covered under the scheme. Aggrieved over the same, the petitioner preferred an appeal before the 2nd respondent and the 2nd respondent has not taken any decision on the appeal filed by the petitioner. Therefore, the petitioner is before this court.

2.When this writ petition is taken up for hearing, the learned Additional Government Pleader, who takes notice for the respondents submits that the appeal preferred by the petitioner was already rejected.

3.In view of the above submission, this writ petition is disposed of with a direction to the respondents to ensure that the copy of the order passed in the petitioner's appeal is served on the petitioner within a period of one week from the date of receipt of a copy of this order. No costs.
