O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to take necessary and immediate action based on the petitioner’s representation dated 30.08.2025, seeking to cancel the classification of the land in Survey No.1525/1B1B1, Kilathiruthangal Village, Sivagasi Taluk, Virudhunagar District (Patta No. 641), as Natham Poramboke, to revoke the Natham Pattas issued to third parties and to restore possession of the property to the petitioner’s family, within the time frame to be fixed by this Court.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The grievance of the petitioner is that the subject property belongs to the petitioner’s family, devolved upon them by way of succession. They have been in continuous possession and enjoyment of the same for several decades. However, the respondents, without any notice or intimation to the petitioner’s family, illegally reclassified their patta land as Natham Poramboke, subdivided the same and issued Natham Pattas to third parties, who have no right, title or interest in the property. The petitioner submitted a representation dated 30.08.2025 to the respondents seeking cancellation of the classification of the land as Natham Poramboke, revocation of the Natham Pattas issued to third parties and restoration of possession of the property to the petitioner’s family. However, no action has been taken on the petitioner’s representation. Hence, the petitioner has been constrained to file the present Writ Petition.
4. The learned Special Government Pleader appearing for the first to fourth respondents, on instructions, would submit that the petitioner's representation dated 30.08.2025 would be considered and appropriate orders would be passed by the second respondent within a period of twelve weeks.
5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to consider the petitioner's representation dated 30.08.2025 and pass appropriate orders on its merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be disposed of after conducting an enquiry. The second respondent is also directed to provide a reasonable opportunity of hearing to the petitioner and any other interested parties who may be affected by such decision, before passing any order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. There shall be no order as to costs.
