O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second respondent herein to consider the petitioner’s representation dated 12.08.2025 and to conduct an enquiry with regard to Patta No.2347 and cancel the same.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

The grievance of the petitioner is that land measuring an extent of 4.5 cents out of the total extent of 18 cents in S.No.182/2, belonging to the petitioner, was acquired by the Government for the purpose of forming a stream when the land was in the possession of the petitioner’s predecessors. Thereafter, the said land was subdivided into S.No.182/2B measuring an extent of 1.5 cents which is in the possession of the petitioner and S.No.182/2A1D acquired by the Government. After acquiring the land, the Government laid a road in the said property.

4. Therefore, though the revenue officials could not grant patta in respect of the land in S.No.182/2A1D, the third respondent issued Patta No.2347 in favour of one Sundara Nadar and eight others. Though the petitioner submitted a representation dated 12.08.2025 to the respondents seeking to conduct an enquiry and to cancel the said patta, no action has been taken either to conduct an enquiry or to cancel the patta. Hence, the petitioner has been constrained to file the present Writ Petition.

5. The learned Government Advocate appearing for the respondents, on instructions, would submit that the petitioner's representation dated 12.08.2025 would be considered and appropriate orders would be passed by the second respondent within a period of sixteen weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to consider the petitioner's representation dated 12.08.2025 and pass appropriate orders on its merits and in accordance with law within a period of sixteen weeks from the date of receipt of a copy of this order. The representation shall be disposed of after conducting an enquiry. The second respondent is also directed to provide a reasonable opportunity of hearing to the petitioner and any other interested parties who may be affected by such decision, before passing any order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. There shall be no order as to costs.
