ORDER

This Writ Petition has been filed seeking to direct the 1st respondent to disburse the Earned Leave Salary for 64 days to the tune of Rs.1,59,658/- by considering the petitioner’s representation dated 12.12.2025, in light of the 1st respondent’s letter in Na.Ka. No.1599/Cane/91/E1, dated 19.03.2024 and the 2nd respondent letter in Na.Ka. No.1121/E1/2024, dated 11.04.2025.

2. Mr.K.Surendran, learned Additional Government Pleader takes notice on behalf of the respondents.

3. In view of the consent expressed by the learned counsel on either side, the Writ Petition is taken up for final disposal at the stage of admission itself.

4. The case of the petitioner is that the petitioner joined the 1st €

respondent Sugar Mill as Junior Assistant on 20.05.1991and thereafter, he was promoted to the post of Superintendent and subsequently promoted to the post of Office Manager on 21.02.2024 and transferred to the 2nd respondent Sugar Mill. The grievance of the petitioner is that he was paid earned leave salary only for 90 days and the remaining amount has been withheld by the 1st respondent. Therefore, the petitioner made a representation dated 12.12.2025 to the 1st respondent, seeking disbursal of the earned leave for the remaining period of 194 days. However, the same has not been considered till date. Therefore, the petitioner has preferred the present Writ Petition.

5. Learned counsel appearing for the petitioner submitted that it would suffice, if this Court issues a direction to the 1st respondent to consider the representation of the petitioner dated 12.12.2025 and pass appropriate orders on the same within the time that may be stipulated by this Court.

6. On the above contention, this Court heard the learned counsel appearing for the respondents.

In view of the limited relief sought for by the petitioner, this Court without expressing any opinion on the merits of the case, directs the 1st respondent to consider the petitioner’s representation dated 12.12.2025 and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner.

8. This Writ Petition stands disposed of with the aforesaid direction. No costs.
