Senthil ...Respondents Prayer: Writ Petition is filed under Section 226 of the Constitution of India for issue of Writ of Mandamus, directing the respondents 1 to 3 to consider the petitioner’s representation dated 09.12.2025 for alloting the land measuring 0.84.74 sq. metres comprised in Survey No. 437/3, Sendharapalli Village, Krishnagiri Taluk, Krishnagiri District, for the purpose of erecting a permanent flag pole and conducting flag hoisting ceremonies on national days such as Republic Day, Independence Day etc., by the Ex-Military Servicemen Welfare Association, within a time frame to be fixed by this Court.

O R D E R
This writ petition is filed for the following relief:
“To direct the respondents 1 to 3 to consider the petitioner’s representation dated 09.12.2025 for allotting the land measuring 0.84.74 sq. metres comprised in Survey No. 437/3, Sendharapalli Village, Krishnagiri Taluk, Krishnagiri District, for the purpose of erecting a permanent flag pole and conducting flag hoisting ceremonies on national days such as Republic Day, Independence Day etc., by the Ex-Military Servicemen Welfare Association, within a time frame to be fixed by this Court.”
2. The case of the petitioner is that he is currently serving as a President of the Ex-Military Servicemen Welfare Association and there are more than 50 members in the said association. He would submit that the said association has been organizing events, namely, the Republic Day (January 26), Kargil Vijay Diwas (July 26), Independence Day (August 15) and Vijay Diwas (December 16). At the end of the above events, they have been successfully organizing a flag hoisting celebration in a natham poromboke land belonging to the Government.

While so, on 08.12.2024, the 4th and 5th respondents herein came to the said area with their men and destroyed the flag post and robbed the sand and stones that were laid out and escaped from the premises. The petitioner lodged a police complaint on 09.12.2024, before the Guruparappalli Police Station and C.S.R.No.400/2024 was also issued.

Thereafter, the 3rd respondent compromised the issue between the petitioner and the 4th and 5th respondents and assured that an alternate place would be allotted for conducting flag hoisting events. Thereafter, the petitioner sent a representation dated 19.07.2025, to respondents requesting for an alternate location. Since there is no response the petitioner approached this Court vide WP.No.29920 of 2025 and this Court by order dated 08.08.2025, directed the 3rd respondent to conduct an enquiry and to ensure that the flag hoisting event was conducted peacefully. Accordingly, the flag hoisting event was conducted on 15.08.2025, peacefully.

The petitioner’s case is that they conduct flag hoisting events four times every year and therefore, he made a representation dated 09.12.2025 to respondents 1 to 3 seeking to allot the said land to the association for the purpose of erecting flag pole. Aggrieved by the inaction on the side of respondents 1 to 3, the petitioner is before this Court.
6. The learned Special Government Pleader would submit that the petitioner’s representation dated 09.12.2025 will be considered and orders passed.
7. Recording the above submission, this writ petition is allowed, directing the respondents 1 to 3 to consider the petitioner’s representation and pass orders on merits and in accordance with law, within a period of 3 weeks from the date of receipt of a copy of this order. No costs.
