Prayer: This writ petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondent to disburse the belated payment of interest amount of Provident fund, gratuity and Earned Leave salary amounts and other unsettle benefits of difference amount of pension arrears, Gratuity and Earned Leave Salary as per 12(3) wage settlement and 10 days salary with effect from 01.07.2024.

ORDER

This writ petition is filed to direct the respondent to disburse the belated payment of interest amount of Provident fund, gratuity and Earned Leave salary amounts and other unsettled benefits of difference amount of pension arrears, Gratuity and Earned Leave Salary as per 12(3) wage settlement and 10 days salary with effect from 01.07.2024.

2. By consent of both the parties, this writ petition is disposed of at the stage of admission itself.

3. The case of the petitioner is that the petitioner was retired from the respondent corporation and paid the terminal benefits, belatedly. Hence, he is eligible for interest amount for belated payments of Provident Fund, Gratuity and Earned Leave Salary amounts and other unsettled benefits of Difference amount of Pension arrears, Gratuity and Earned Leave Salary as per 12(3) Wage Settlement and 10 days salary with effect from 01.07.2024. However, the same was not settled to the petitioner. Therefore, he made a representation dated 09.12.2025 to the respondent, seeking aforesaid terminal benefits along with interest. But, the said representation was not considered, as on date. Hence, this writ petition.

Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that it would suffice, if this Court issues direction to the respondent to disburse the interest amount for belated payment of terminal benefits and other unsettled benefits of difference amount of pension arrears, gratuity and earned leave salary, as per 12(3) wage settlement and 10 days salary with effect from 01.07.2024.

5. Learned counsel appearing for the respondent would submit that the petitioner’s claim will be considered by the respondent, within a time frame to be fixed by this Court.

6. Heard the learned counsel on either side and perused the materials available on record.

Considering the relief sought by the learned counsel for the petitioner, this Court deems it appropriate to direct the respondent to consider the petitioner's representation dated 09.12.2025 and pass appropriate orders on merits within a period of eight (8) weeks from the date of receipt of a copy of this order, with regard to payment of interest amount for belated payment of Provident fund, Gratuity and Earned Leave Salary and other unsettled benefits of difference amount of Pension arrears, Gratuity and earned leave salary, as per 12(3) settlement and 10 days salary with effect from 01.07.2024. It is made clear that the petitioner shall be paid interest at the rate of 6% per annum for the benefits to which he is entitled to.

With the aforesaid direction, this writ petition stands disposed of. No costs.
