S.D.Saravanan as Technical Assistant, on compassionate ground, within a reasonable Period as may be fixed by this Honorable Court.

ORDER

This Writ Petition has been filed seeking a direction to the first respondent to pass order on the proposal of the second respondent sent in Letter Na.Ka.No.10755 /2020 / F4 dated 07/07/2021 to appoint the petitioner as Technical Assistant in Tiruchirappalli City Municipal Corporation, in the light of the orders passed by the Commissioner, Tiruchirappalli City Municipal Corporation in Na.Ka.No.10145 /2007 / C1 (Main) dated 30/06/2014 appointing one Thiru. S.D.Saravanan as Technical Assistant, on compassionate ground, within a reasonable time as fixed by this Court.

2. Heard the learned counsels appearing on either side. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.

3. The learned counsel for the petitioner submitted that on the demise of the petitioner’s father in service as a sanitary supervisor with the third respondent Corporation, the petitioner was appointed as an unskilled labour on compassionate ground by the third respondent vide proceedings dated 08.09.2008, though he was eligible for appointment as Technical Assistant as he acquired First Class in Diploma [Electrical Engineering]. He further submitted that the petitioner made representations in this regard to the third respondent, who in turn sent a proposal to the first respondent through the second respondent vide proceedings dated 07.02.2021, however there was no response till date and hence, the present Writ Petition.

4. Considering the facts and circumstances of the case and also taking note of the educational qualification of the petitioner, this Court directs the first respondent to consider and dispose of the petitioner’s representation dated 20.01.2020 addressed to the third respondent in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

5. With the above direction, the Writ Petition stands disposed of. There shall be no orders as to costs.
