ORDER

This Criminal Original Petition has been filed seeking a direction to the first respondent to transfer the investigation pending in Crime No.500 of 2025 on the file of the second respondent to the file of the third respondent. To be noted, since the prayer has not been happily worded, this Court has tweaked the prayer to make it sensible.

2. The case of the petitioner is that the his daughter who was pursuing her Post-Graduation in Medicine, was found dead under suspicious circumstances on 06.07.2025. Based on the complaint lodged by the petitioner, a case in Crime No.500 of 2025 was registered under Section 194 of BNSS, 2023. Alleging that the investigation has not been conducted properly, the present petition has been filed by the petitioner/ de facto complainant seeking transfer of investigation, as aforesaid.

3. The learned counsel for the petitioner submitted that after the death of the victim, certain amounts were transferred from her account and the respondents have failed to conduct a proper and effective investigation.

4. The learned Government Advocate (Criminal Side) appearing for the respondents submitted that based on the complaint given by the petitioner, the aforesaid case in Crime No.500 of 2025 has been registered under Section

194 of BNSS, 2023 and that the investigation is being carried out in a proper line. With regard to the contention of the petitioner as regards transfer of amounts from the victim’s account post her demise, he submitted that the second respondent understands that instructions for such transfers had been given by her prior to her demise and accordingly, the second respondent is conducting investigation on that aspect also. He reiterated that the investigation is being conducted properly. He submitted that if the petitioner has any grievance as regards the manner in which the investigation is being conducted by the second respondent, the same may be addressed before the Assistant Commissioner of Police, who will monitor the investigation being conducted by the second respondent.

Taking into consideration the submissions made by the learned counsel on either side, there shall be a direction to second respondent to complete the investigation as expeditiously as possible, preferably within a period of four months from the date of receipt of a copy of this order. It is made clear that the investigation done by the second respondent shall be monitored by the Assistant Commissioner of Police, Peelamedu Range.
