ORDER
This Criminal Original Petition is filed to call for the records in connection with the impugned FIR in Crime No.323/2024 on the file of the first respondent police and quash the same in so far as the petitioner is concerned.

Learned counsel for the petitioner submitted that the petitioner is the sole accused in the csae registered in Crime No.323 of 2024 on the file of the first respondent for the offences under Sections 303(2) of Bharatiya Nyaya Sanhita, 2023(Sand theft) on the alleged complaint filed by the second respondent Village Administrative Officer.
3. However, the learned counsel for the petitioner categorically contended that he had transported sand only after obtaining proper permit from the Tahsildar concerned. Pusuant to his submission, this Court had directed the learned Government Advocate(Crl.side) to get a report from the Tahsildar of Vasudevanallur, as to whether any permit was obtained by the petitioner in this regard.
4. Learned Government Advocate(Crl.side) on the basis of the report obtained from the Tahsildar fairly contended that the petitioner had transported sand only after obtaining proper permit from the Tahsildar concerned.
5. In view of the submission made by the learned Government Advocate(Crl.side) and the report submitted by the Tahsildar, Vasudevanallur, the offences registered against the petitioner will not be made out, since he had transported the sand only after obtaining proper permit. Accordingly, the impugned FIR in Crime No.323/2024 on the file of the 1st Respondent Police, is quashed.
6. This Criminal Original Petition is allowed. Consequently, connected miscellaneous petition stands closed.
