PRAYER;This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Certiorarified Mandamus, Call for the records relating to the impugned order issued by the 3rd respondent in Na.Ka. no 5252/ A4 / 2024 dated 28.05.2025 and to quash the same and consequently, directing the 3rd respondent to restore the petitioner as B.T Assistant (Science) in the 5th respondnet School with consequential and other attendant benefits, within a time frame to be fixed by this Hon'ble Court.

For M/s.S.Nedunchezhiyan For Respondent(s): Ms.Mythreye Chandru, SGP ORDER This petition has been filed seeking to quash the impugned order issued by the 3rd respondent in Na.Ka. no 5252/ A4 / 2024 dated 28.05.2025 and consequently, directing the 3rd respondent to restore the petitioner as B.T Assistant (Science) in the 5th respondent School with consequential and other attendant benefits.

2. It is the case of the petitioner that he was appointed as B.T.Assistant (Science) in the 5th respondent School in the year 2010. His appointment was duly approved by the Department. He possess M.Sc. Qualification, which makes him fully eligible for promotion to the post of PG Assistant (Chemistry). A vacancy to the said promotional post arose on 01.08.2024 due to the retirement of the incumbent. The petitioner consistently pursued his rightful claim for promotion. His eligibility and seniority were never in dispute. Anticipating and subsequent to the vacancy, the petitioner submitted representations to the competent authorities on 17.02.2024, 01.08.2024 and

26.10.2024. The Headmaster of the 5th respondent School, by proceedings dated 13.11.2024, informed that the petitioner's promotion would be considered. While the said claim was pending, the petitioner was abruptly declared surplus. This action was initiated without considering the existing vacancy and the petitioner's eligibility. The 3rd respondent issued an impugned deployment order dated 28.05.2025 seeking to deploy the petitioner to another aided school at Adyar, Chennai. Challenging the same, the present writ petition has been filed.

3. The learned Senior counsel for the petitioner submitted that the petitioner has already filed a writ petition in WP.No.45439 of 2025 before this Court claiming promotion and the same is pending. This court may close this writ petition by observing that the impugned order is subject to the result of the writ petition which is pending before this Court.

4. Heard the learned counsel for both side and perused the materials available on record.

5. In view of the above, this Court without going into the merits of the case, disposed the writ petition and the present impugned order is subject to the result of the writ petition vide WP.No.45439 of 2025, which is pending before this Court.

6. With the above directions, the writ petition is disposed of. No costs.

Consequently, connected miscellaneous petitions are closed.
