PRAYER : Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus or any other writ or order or Direction in the nature of Writ of Mandamus directing the respondents to grant permission and police protection to conduct Cock Fight in the event of Pongal Festival at Shanmugavalli Thottam, Sri Vigneshwara Mariyamman Temple Backside, Kavinthapadi Pudur Village, Bhavani Taluk, Erode District from 12.01.2026 to 15.01.2026 between 9.00 am to 6.00 pm by considering petitioners representation dated 30.12.2025.

ORDER

This Writ Petition has been filed seeking a direction to the respondents to consider the representation of the petitioner dated 30.12.2025 and grant permission and police protection to conduct Cock Fight in the event of Pongal Festival at Shanmugavalli Thottam, Sri Vigneshwara Mariyamman Temple Backside, Kavinthapadi Pudur Village, Bhavani Taluk, Erode District from

12.01.2026 to 15.01.2026 between 9.00 am to 6.00 pm

2. Mr.K.M.D.Muhilan, learned Additional Public Prosecutor takes notice on behalf of the respondents.

3. Today, when the matter was taken up for hearing, learned Government Advocate (Crl. Side) appearing for the respondents submitted that by a Circular Memorandum of the Director General of Police, Head of Police Force, Tamil Nadu, in Rc.No.3830-1/Crime 4(3)/2025, dated 12.09.2025, Cock Fight has been banned in the State of Tamil Nadu. He also produced a copy of the order dated 09.10.2025 passed by this Court in W.P.(MD).No.27950 of 2025, wherein in a similar matter, the writ petition was dismissed observing as follows:

“A writ of mandamus can be issued only to enforce a legal right or a legal duty. The Petitioner has no legal right. On the other hand, the statute expressly prohibits an animal fight event organised by human beings.”

4. At this juncture, the learned counsel for the petitioner submitted that the petitioner may be granted liberty to challenge the above said circular.

5. In view of the above submission made by the learned Government Advocate (Criminal Side) and in the light of the order dated 09.10.2025 passed by this Court in W.P.(MD).No.27950 of 2025, the petitioner has no legal right to conduct Cock Fight which is banned in the State of Tamil Nadu.

6. Accordingly, this writ petition (criminal) stands dismissed.
