ORDER
The present writ petition has been filed seeking a mandamus as against the respondent to enter the correct name of the petitioner in the birth certificate of his daughter.
2. According to the learned Counsel appearing for the writ petitioner, the petitioner's original name is Kannan Vadivel and he got converted to Islam and changed his name as V.Muhammed Rafeeque and the change of name was also notified in the Tamil Nadu Government Gazette on 11.07.2018.
3. The petitioner had got married to one Femina Fathima and she had given birth to a female child, namely, Rafaa, on 22.11.2020. The birth certificate has been issued by the respondent on 09.12.2020, wherein the name of the petitioner is reflected as Kannan Vadivel instead of V.Muhammad Rafeeque. Hence, the petitioner has given a request on 21.06.2022 to incorporate his name in the birth certificate. Since the said request has not been considered, the present writ petition has been filed.
4. The learned Special Government Pleader appearing for the respondent submitted that even while the girl child was born to the writ petitioner, the petitioner has already changed his name. However, only due to the mistake on the part of the petitioner, wrong name was entered in the birth certificate and therefore, the petitioner cannot make a complaint as against the respondent.
5. Considering the fact that the petitioner has changed his name after conversion to Islam and the change of name has also been notified in the Tamil Nadu Government Gazette on 11.07.2018, this Court is of the considered opinion that the respondent could be directed to incorporate the name of the petitioner, namely, V.Muhammad Rafeeque in the place of Kannan Vadivel in the birth certificate.
6. In view of the above said deliberations, this writ petition stands allowed and the respondent is directed to incorporate the name of V.Muhammad Rafeeque in the place of Kannan Vadivel and issue a fresh birth certificate to the petitioner based upon his representation dated 15.12.2025. The said exercise shall be completed within a period of 6(six) weeks from the date of receipt of a copy of this order. No costs.
