O R D E R

The present writ petition has been filed seeking to quash the order passed by the second respondent herein, wherein, the request of the petitioner for issuance of Legal Heir Certificate for death of her father has been rejected as her grandfather's name has been wrongly included.

2. According to the learned counsel appearing for the writ petitioner, the petitioner's grandfather's, name is Aathilinga Reddiyar and not Shanmuga Reddiyar and she is having records to establish the same. However, without hearing the petitioner, the present impugned order has been passed. Hence, he prays for setting aside the order.

3. Considering the fact that the order impugned in the writ petition has been passed without hearing this petitioner, the order impugned in the writ petition is set aside and the matter is remitted back to the second respondent. The second respondent is directed to give an opportunity to the writ petitioner to establish the name of her grandfather. After going through the records and considering the documents to be presented by the writ petitioner, the second respondent is directed to pass fresh orders within a period of twelve weeks from the date of receipt of documents from the petitioner.

4. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petition stands closed.
