PRAYER Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of a Writ of Mandamus, directing the 2nd respondent herein to sanction and disburse the admissible pension along with DA and all other retirement and terminal benefits due and payable to petitioner’s (late) husband G.Kannan, along with arrears from the date of death of her husband I.e 08.07.2015, together with applicable interest thereon, within a time frame that may be stipulated by this Court.

ORDER

This Writ Petition has been filed seeking to direct the 2nd respondent herein to sanction and disburse the admissible pension, along with DA and all other retirement and terminal benefits due and payable to petitioner’s (late) husband G.Kannan, along with arrears from the date of death of her husband i.e on 08.07.2015, together with applicable interest thereon.

2. Mr.S.Balamurugan, learned Government Advocate takes notice on behalf of the respondents. In view of the consent expressed by the learned counsel on either side, the Writ Petition is taken up for final disposal at the stage of admission itself.

3. The case of the petitioner is that the petitioner’s husband was employed as a Junior Engineer (General) in the Highways Department and he took voluntary retirement from the service on 31.08.2012. Later, on 08.07.2015, he died in a road accident. The grievance of the petitioner is that since her husband had voluntarily retired from the service, the Authorities have yet to settle the pension and other terminal benefits due to him. Therefore, the petitioner made a representation before the first respondent. However, the same has not been considered till date. Hence, the petitioner has preferred the present Writ Petition.

4. Learned Counsel appearing for the petitioner submits that it would suffice, if this Court issues a direction to the first respondent to consider the representation of the petitioner and pass appropriate orders on the same within the time that may be stipulated by this Court.

5. On the above contention, this Court heard the learned counsel appearing for the respondents.

6.In view of the limited relief sought for by the petitioner, this Court without expressing any opinion on the merits of the case, directs the petitioner to submit a fresh representation, along with a copy of this order, before the first respondent, within a period of two (2) weeks from the date of receipt of a copy of this order. Upon receipt of such representation, the first respondent shall consider the same on merits and pass appropriate orders in accordance with law within a period of six (6) weeks thereafter, after affording an opportunity of hearing to the petitioner and any other interested parties. It is made clear that the petitioner would be entitled to interest @ 6% per annum for the benefits to which he is entitled to towards belated payment.

7. This Writ Petition stands disposed of with the aforesaid direction.

There shall be no order as to costs.
