PRAYER Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of a Writ of Mandamus, directing the respondents 2 to 4 to settle the petitioner his retirement benefits and other benefits, together with interest.

ORDER

This Writ Petition has been filed seeking to direct the respondents 2 to 4 to settle the petitioner his retirement benefits and other benefits, together with interest.

2. Mr.S.Ravichandran, learned Additional Government Pleader takes notice on behalf of the respondents. In view of the consent expressed by the learned counsel on either side, the Writ Petition is taken up for final disposal at the stage of admission itself.

3. The case of the petitioner is that the petitioner was appointed as a Junior Assistant in the office of the fourth respondent on 19.09.1986 and he retired from service on 30.06.2018. The grievance of the petitioner is that he has not been settled the retirement benefits till date. Therefore, a representation dated 18.05.2022 was made before the Chief Mister Cell of Tamil Nadu and later, a representation dated 19.05.2022 to the third respondent, seeking to settle the petitioner’s leave salary, special provident fund, gratuity and arrears of pension from the year 2018 till date. However, the same has not been considered till date. Therefore, the petitioner has preferred the present Writ Petition.

Learned Counsel appearing for the petitioner submits that it would suffice, if this Court issues a direction to the respondents to consider the representation of the petitioner dated 19.05.2022 and to consequently, settle the retirement benefits and other benefits in favour of the petitioner, along with applicable interest.

Learned Additional Government Pleader appearing for the respondents submitted that though the petitioner has made representation to the third respondent, however the competent authority to consider the claim of the petitioner is the fourth respondent. Hence, he submitted that, if any such representation is made before the 4^th respondent, the same will be considered and appropriate orders will be passed within the time stipulated by this Court.

In view of the above submissions, this Court without expressing any opinion on the merits of the case, directs the petitioner to submit a copy of the representation dated 19.05.2022, along with a copy of this order before the fourth respondent, within a period of two (2) weeks from the date of receipt of a copy of this order. Upon receipt of such representation, the fourth respondent shall consider the same on merits and pass appropriate orders in accordance with law within a period of six (6) weeks thereafter, after affording an opportunity of hearing to the petitioner and any other interested parties. It is made clear that the petitioner would be entitled to interest @ 6% per annum for the benefits to which he is entitled to towards belated payment.

7. This Writ Petition stands disposed of with the aforesaid direction.

There shall be no order as to costs.
