This Writ Petition has been filed to forebear the respondents 1 to 5 from allowing the 6^th respondent to erect the windmill within 300 meters from quarry site in S.No.188/2 morefully in S.No.l88 situated at Thirukuranam Village, Gujiliyamparai Village, Dindigul District.

When this matter came up for hearing on 07.01.2026, the learned Additional Government Pleader appearing for the respondents 1 to 3 and 5 submitted that in the event, subject windmill is erected 300 meters away from the quarry, no approval is required and sought for an accommodation to verify as to whether the place where the windmill is to be erected is 300 meters away from the quarry site or not. Subsequently, when the matter was listed on 09.01.2026, the Tahsildar, Gujiliyamparai, filed a report to the effect that 'Nkwg; b fyF; thup mikeJ; ss; ,ljj; pypUe;J 300 kPll; u; njhiytpy; fhw;whiy epWTk; gzp eilngwW; tUfpwJ'. The above report did not disclose whether the windmill is situated within 300 meters or 300 meters away from the quarry site.

Today, when the matter is taken up for hearing, the learned Additional Government Pleader appearing for the respondents 1 to 3 and 5 would submit that the windmill is going to be erected 300 meters away from the quarry site and therefore, no approval is required in the present case. This submission is recorded.

4. The learned senior counsel appearing for the petitioner would also submit that in the event if the windmill is going to be erected 300 meters away from the quarry site, requirement of obtaining approval is not necessary.

5. Upon hearing either sides, it is clear that the sixth respondent is going to erect the windmill 300 meters away from the quarry site and hence, no approval is required for erection of windmill as per Rule

36(1-A)(c) of the Tamil Nadu Mining Mineral Concession Rules, 1959.

6. Recording the above, this Writ Petition is disposed of. No costs.

Consequently, connected Miscellaneous Petitions are closed.
