Respondents Prayer: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, to direct the respondents nos 1 to 5 to remove the encroachments of the respondents 6 to 12 made in the petitioners village tank namely Vellazhangadu Water Tank, Situating in the land Survey nos.221/5, 221/6 and 221/7 in Vellazhangadu Village, Ruthira Sinthamani revenue Village, Peravurani Taluk, Thanjavur District by considering the petitioner's representation dated 06.10.2025 within the time limit that may be stipulated by this Court.

ORDER

Heard the learned counsel for the writ petitioner and the learned Additional Government Pleader for the official respondents. Issuance of notice to the private respondents is dispensed with.

2. The petitioner is a resident of Vellazhangadu Village. He alleges that in the petition mentioned survey numbers, there are encroachments.

3. Copy of the 'A' register has been produced before us. It is seen that S.Nos.221/5, 6 & 7 have been classified as “lake”. It is under the control of the water resources department. The respondents 4 & 5 are directed to take action under the Tamil Nadu Protection of Tanks and Eviction of Encroachment Act, 2007 and clear all the encroachments. It appears that there are still some more encroachments. All the encroachments will be removed within a period of three months from the date of receipt of a copy of this order.

4. The writ petition is allowed accordingly. No costs.
