Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus for call the records pertaining to the impugned order passed by the first respondent vide his office proceedings Oo.Mu.No.00027/KA.P1/1/2023 dated 15.06.2023 and quash the same consequently, directing the respondents 1 to 3 to reimburse the medical expenses of Rs.1,55,394/- incurred by the petitioner for taking medical treatment Lotus Hospitals and Research Centre Limited, Kollampalayam, Erode with interest at the rate of 12% from 17.12.2021 i.e. the date of last payment made by the petitioner to the hospital till date of reimbursement made to the petitioner within the time fixed by this Court.

O R D E R

The petitioner has filed this writ petition seeking to quash the order passed by the first respondent dated 15.06.2023 and to direct the respondents 1 to 3 to reimburse the medical expenses incurred by the petitioner for taking medical treatment at Lotus Hospitals and Research Centre Limited, Kollampalayam, Erode, with interest at the rate of 12% from 17.12.2021 till date of reimbursement made to the petitioner.

2.The learned counsel appearing for the petitioner submitted that the petitioner retired on 31.03.2009 as Headmaster from Government Aided Primary School, Rakkiyavalasu, Tiruppur District and after retirement, enrolled in the New Health Insurance Scheme, 2018 for pensioners / family pensioners as per G.O.Ms.No.222, dated 30.06.2018. Due to severe pain in stomach, the petitioner took treatment at Lotus Hospitals and Research Centre Limited, Kollampalayam, Erode as inpatient from 22.11.2021 to 01.12.2021 and laparotomy was performed on 23.11.2021 and incurred medical expenses to the tune of Rs.1,22,552/-. Thereafter, for post operative complaints, the petitioner was admitted in the very same Hospital from 13.12.2021 and was discharged on 17.12.2021 and incurred medical expenses to the tune of Rs.27,842/-. The total medical expenses incurred is Rs.1,50,394/-.

3.The learned counsel appearing for the petitioner further submitted that the petitioner submitted all the bills and medical records to the fourth respondent for reimbursement of the above amount and the fourth respondent forwarded the same to the third respondent. Thereafter, the second respondent vide communication dated 16.08.2022 directed the petitioner to submit the originals and the petitioner also submitted the same, however, the petitioner’s claim was rejected and aggrieved by the same, the petitioner preferred appeal before the first respondent and the first respondent passed the impugned order and aggrieved by the same, the petitioner filed this writ petition.

4.The learned Government Advocate appearing for the respondents submitted that during the pendancy of this writ petition, the Commissioner of Treasuries and Accounts, Tamil Nadu, Chennai issued proceedings dated 17.04.2024 sanctioning a sum of Rs.30,000/- towards the petitioner’s claim of medical reimbursement by observing that the State Level Empowered Committee has recommended the claim of the petitioner awarding a sum of Rs.30,000/- as the eligible amount to be disbursed.
