Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the order passed by the second respondent in Na.Ka.No. 1808/2013/C1 dated 16.12.2023 and quash the same is totally illegal, improper, unreasonable, arbitrary and principles of natural justice and thereby direct the respondents to regularize the petitioner’s service as a Typist with effect from 26.07.2001 and fix the regular time scale of pay from such date instead of 27.02.2006, in pursuance to the G.O. Ms.No.125, Municipal Administration and Water Supply Department dated 27.05.1999.

O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus to call for the records pertaining to the order passed by the second respondent in Na.Ka.No. 1808/2013/C1 dated 16.12.2023 and quash the same is totally illegal, improper, unreasonable, arbitrary and principles of natural justice and thereby direct the respondents to regularize the petitioner’s service as a Typist with effect from 26.07.2001 and fix the regular time scale of pay from such date instead of 27.02.2006, in pursuance to the G.O. Ms.No.125, Municipal Administration and Water Supply Department dated 27.05.1999.

2.The learned counsel appearing for the petitioner submitted that the petitioner was appointed as a Typist on 26.07.2000 on daily wage basis on consolidated pay and after completion of one year, the petitioner made representation dated 27.07.2001 to the second respondent seeking regularization of service and time scale of pay, however, no order was passed and hence, the petitioner filed W.P.No.29067 of 2013 and pursuant to the order of this Court dated 30.07.2020 made in the said writ petition, the impugned order was passed. The learned counsel further submitted that the issue with regard to the regularization of service of the employee from the date of appointment is pending before the Hon’ble Apex Court in S.L.P. (Civil) No.21249 of 2017. Hence, this Court may without going into the merits of the case, grant liberty to the petitioner to make fresh representation to the respondents after disposal of S.L.P.(Civil)

3.Considering the limited relief now sought for by the learned counsel appearing for the petitioner, this Court without expressing any opinion on the merits of the case and without interfering with the order impugned in this writ petition, grants liberty to the petitioner to make fresh representation to the respondents after disposal of S.L.P.(Civil)

No.21249 of 2017. The writ petition is disposed of. No costs.
