Respondents PRAYER :- This Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents 1 to 4 to initiate appropriate action as against the 5^th respondent for excommunicating the petitioner and his family members from worshipping and participating in the village temple festival namely, Sri MaruthakiniAyyanar and Sri Muthu Sonaiyan and Sakthi Mariyamman Temple situates at Marutthani Village, Eluvankkottai, Devakkottai Taluk, Sivagangai District and consequently direct the respondents 1 to 4 to convene peace meeting to ensure the petitioner to perform pooja in the above said temple, by considering his representation dated 29.12.2025.

ORDER

This writ petition has been filed seeking issuance of Writ of Mandamus, directing the respondents 1 to 4 to initiate appropriate action as against the 5^th respondent for excommunicating the petitioner and his family members from worshipping and participating in the village temple festival namely, Sri MaruthakiniAyyanar and Sri Muthu Sonaiyan and Sakthi Mariyamman Temple situates at Marutthani Village, Eluvankkottai, Devakkottai Taluk, Sivagangai District and consequently direct the respondents 1 to 4 to convene peace meeting to ensure the petitioner to perform pooja in the above said temple, by considering his representation dated 29.12.2025.

2. Heard the learned counsel on either side.

3. It is seen that the fifth respondent had already filed a writ petition in W.P.(MD)No.1299 of 2025 and this Court vide order dated

09.09.2025 has rendered finding, which reads as follows:

“3.This Court is of the view that the police cannot interfere in such disputes. If the petitioner is aggrieved by any action of the rival parties, which affects his rights, it is for him to approach the civil Court. However, if the petitioner and the other villagers, who are not impleaded here, jointly conduct the “Aavani Pongal worship” between 4.00 pm and 7.00 pm on 09.09.2025, as suggested by the respondents herein, the respondents have no objection for the same.”

4. When the order says to jointly conduct the pongal festival, a separate order is not necessary. Hence, this Writ petition (Criminal) is dismissed. The petitioner and the private respondent shall worship jointly.
