Heard both sides.
2.The petitioner is a minority institution running a school with classes up to 8th Standard. By the impugned order, the petitioner had been directed to be closed and the students from 6th to 8th standard were directed to be shifted to another school. The petitioner has been enjoying the interim order right from the time of inspection. Since, for the last 6 years, the petitioner had enjoyed the interim order, we do not propose to disturb the status quo for the present.
3.The learned Senior Counsel appearing for the petitioner states that the impugned order was passed pursuant to the order dated 22.09.2019 made in W.P(MD)No.242 of 2019. The said direction has been set aside today by this Court in W.A(MD)No.107 of 2019.
4.In this view of the matter, the order impugned in the writ petition is set aside. We make it clear that it is entirely for the writ petitioner to obtain proper renewal / recognition / affiliation within the next three months from the competent authority. If the petitioner is unable to do so, the petitioner school shall not be allowed by the authorities to function from the next academic year onwards.
5.With the aforesaid directions, this Writ Petition is allowed. No costs. Consequently, connected miscellaneous petitions are closed.
