O R D E R

Alleging that the order of this Court dated 24.04.2025 in Crl.O.P.No.12813 of 2025 has not been complied with, the petitioner has come up with this contempt petition.

The learned counsel appearing for the petitioner would submit that the petitioner had filed a Criminal Original Petition in Crl.O.P.No.12813 of 2025 before this Court, seeking a direction to the respondents to complete the investigation in Crime No.97 of 2021, which was registered for offence under Section 147, 148, 295 A IPC and 3(1) of TNPPDL Act and file a final report within a stipulated time. This Court, by order dated 24.04.2025, had directed the respondents/police to complete the investigation in Crime No.97 of 2021 pending on their file and file a final report, within a period of four weeks from the date of receipt of a copy of that order. However, since the order has not been complied with, the petitioner has come up with this petition.

The learned Additional Public Prosecutor appearing for the respondents submitted that the respondents have completed the investigation as early as on 30.05.2025 in Crime No.97 of 2021, in due compliance of the order of this Court. However, since the case is for the offence under Section 295 A IPC, the respondents are bound to get sanction from the Government and hence, the files have been sent to the Government for sanction and sanction is awaited. He would further submit that awaiting sanction, the respondents had also filed an application in Crl.MP No.21010 of 2025 in Crl.O.P.No.12813 of 2025 before this Court, seeking extension of time to file final report and this Court, by order dated 11.11.2025, had granted extension for three months.

Taking into consideration the fact that the investigation has been completed as early as on 30.05.2025, and sanction is awaited from the Government and further, this Court has also granted extension of three months' time in Crl.M.P.No.21010 of 2025 on 11.11.2025, the question of contempt will not arise.

5. Considering the above facts and circumstances of the case, this contempt petition stands closed. However, the respondents/police are directed to take steps to expedite the process of obtaining sanction from the Government and ensure that the final report is filed before the concerned court at the earliest.
