O R D E R

The petitioner, with a grievance that though he has secured 28 marks out of 50 marks in the written examination, he has not been selected for the post of driver cum conductor, as notified by the Tamil Nadu State Transport Corporation (Tirunelveli Region), Tirunelveli, has approached this Court.

2.The learned counsel appearing for the petitioner submits that the petitioner has participated in the selection process for the post of driver cum conductor, as per the notification issued by the second respondent herein. He has secured 28 marks out of 50 marks. Apart from that, he is having an experience as a temporary driver/conductor in Tamil Nadu State Transport Corporation. In order to substantiate the same, the petitioner has also enclosed the service log sheets for the years 2004, 2006 and 2007. He further submits that the petitioner satisfies all the eligibility criteria, however, his candidature for the post of driver-cum conductor has been rejected.

3.The learned Standing Counsel appearing for the respondent Corporation submits that the writ petitioner belongs to Backward Classes(BC) category and under this Category, 33 vacancies have been allotted and 39 vacancies have been allotted in General Category (GT). As per the Government letter in Lr.(MS) No. 105/C1/2023-1, dated 17.07.2023 issued by the Transport (C1) Department Secretariat, Chennai, candidates, who have qualified in the written examination, were called for interview in the ratio of 1:4 against the notified vacancies. Accordingly, 132 persons were called for interview for 33 vacancies in BC category and 156 persons were called for interview for 39 vacancies in GT category. Among those called for interview in G.T. Category, 143 persons belonged to BC category. Totally 275 persons were called for interview under BC category.

3.1.The learned standing counsel further submits that based on the cut-off score, out of 905 persons, who passed the written test, 793 persons were BC category, where the highest score was 41 and the lowest score was 9. Based on 1:4 ratio in BC category, the highest score was 41 and the cut off marks has been fixed as 29. According to the learned Standing counsel, the petitioner and 61 other candidates have secured 28 marks and none of them were called for interview. Since the writ petitioner did not obtain the requisite score as per the applicable Government orders as well as the appointment Rules governing the post of Driver-cum-

Conductor, he is not eligible for the post of Driver-cum-Conductor.

4.Considering the above submissions made by the learned Standing Counsel that the petitioner has not obtained the requisite score as per the selection procedure, this Court is not inclined to entertain this writ petition.

5.Accordingly, this writ petition is dismissed. No costs.

Consequently, connected Miscellaneous Petition is closed.
