Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the entire records connected with the impugned order passed by the 2nd respondent vide Na.Ka. No.213/ A1/ 2022 dated Nil.11.2022 singed on 02.12.2022 and to quash the same and consequently direct the 2nd respondent to approve the appointment of the petitioner as secondary grade teacher w.e.f. 01.12.2021, with all consequential and monetary benefits For Petitioner : Mr.S.N.Ravichandran For Respondents For R1 to 3 : Mrs.S.Mythreye Chandru, Special Government Pleader

This writ petition has been filed challenging the order dated
02.12.2022 passed by the second respondent thereby rejecting the proposal sent by the fourth respondent for approval of the petitioner’s appointment as Secondary Grade Teacher.
2. The fourth respondent school is a minority aided school.
There was a vacant arose on the demise of one secondary grade teacher. The petitioner was appointed as Secondary Grade Teacher on 29.11.2021 and she joined on 01.12.2021. After her joining, the fourth respondent had sent proposal for approval of the petitioner’s appointment as Secondary Grade Teacher from 01.12.2021. However, it was rejected on the ground that on the date of vacancy, there was surplus teachers under the same diocese of the fourth respondent in Tiruvannamalai District.
Therefore, the appointment of the petitioner was not approved.
3. The learned counsel for the petitioner submits that the fourth respondent school is a two teacher school, in which one is Headmaster and the other is Secondary Grade Teacher. On the demise of one teacher, there was a vacancy and it is a sanctioned post, in which the petitioner was appointed on 01.12.2021 as Secondary Grade Teacher. The petitioner is also qualified with Teacher Eligibility Test and as such, she is fully qualified for appointment as Secondary Grade Teacher.

On perusal of the counter affidavit filed by the second respondent and on submissions of the learned Special Government Pleader appearing for respondents 1 to 3, it is revealed that in the year 2021-2022, insofar as the fourth respondent diocese at Tiruvannamalai District, there were 28 surplus teachers. Though one teacher of the fourth respondent school died, it is to be filled up from the surplus teachers from the other schools of the same diocese. Instead, the fourth respondent appointed the petitioner. Therefore, the approval of the appointment of the petitioner was rightly rejected.
5. In view of the above discussion, this Court finds no infirmity or illegality in the impugned order. Accordingly, this writ petition is dismissed. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
