O R D E R

The above Writ Petition has been filed to quash the transfer order dated

12.11.2025 issued by the third respondent, with regards to transferring the petitioner from Madurai to Vellore and posting the fourth respondent in the place of petitioner.

2. Heard Mr.V.Paneer Selvam, the learned appearing on behalf of the petitioner and Mr.M.Ajmal Khan, learned Additional Advocate General assisted by Mr.F.Deepak, learned Special Government Pleader appearing on behalf of the respondents.

Mr.V.Paneer Selvam learned counsel for the petitioner would submit that the petitioner was appointed as a Junior Employment Officer on 29.01.2010 and was promoted as District Employment Officer on 09.09.2016. Again he was transferred to Theni District on 05.06.2017. On 22.01.2020, the petitioner was promoted as Assistant Director and was transferred to Trichy. On completion of three years, he was transferred to Madurai on 13.07.2023 and he had completed only 2 years at the present station.

4. When that being so, to accommodate the fourth respondent, an order of transfer had been made transferring the petitioner to Vellore by order dated 12.11.2025 which was served on 13.11.2025. He would submit that the orders of promotion of Assistant Director of District Employment Officers were made by the first respondent and they are posted at various places. The fourth respondent had been posted in the place of the petitioner transferring the petitioner to a vacant place at Vellore.

5. He would vehemently contend that the fourth respondent who have been promoted could have been accommodated in Vellore rather than transferring the petitioner at Vellore. He would submit that the transferred place is 400 Kms away from the current place and the transfer had been made during the non-transferable period only to accommodate the promoters to their whims and fancies. He would submit that the petitioner’s family is settled at Madurai and his son is also doing his undergraduate degree in a private engineering college at Madurai. Hence, he seeks indulgence to the order of transfer.

6. Countering, his arguments, Mr.M.Ajmal Khan learned Additional Advocate General would contend that the transfer is an incidence of service. Regular promotions were made by the first respondent from the District Employment Officer to the post of Assistant Director. The fourth respondent is a differently abled person having severe locomotor disability. The fourth respondent who was working as a District Employment Officer had also been promoted as Assistant Director and considering his disability, it was decided to promote him in Madurai where he had bee
