PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus, calling for the records relating to the impugned survey notice dated 02.01.2024 served on 08.01.2024 in reference Nil, issued by the 4th respondent herein and quash the same and consequently direct the respondents desist from interference pending adjudication of the civil suit in AS No.34 of 2023 on the file of the Sub Court, Karur.

O R D E R

This writ petition has been filed challenging the survey notice dated 02.01.2024, issued by the fourth respondent.

2. Heard the learned counsel for the parties.

3. The writ petitioner is aggrieved by the notice issued by the fourth respondent for the purpose of conducting a survey. The petitioner’s grievance is that, since the subject land is in joint patta, his objections have not been considered by the respondents. Moreover, the civil suit is also at the first appeal stage and is pending before the civil court.

4. In response, the learned Additional Government Pleader, appearing on behalf of respondents 1 to 4, submitted that since the notice was issued to the petitioner, it is for the petitioner to raise all objections before the competent authority. If the petitioner raises such objections, they will be considered, and thereafter, the competent authority will pass orders on merits and in accordance with the law.

5. Recording the aforesaid submissions, this writ petition stands disposed of by directing the second respondent/Tahsildar to consider the petitioner’s objections and, thereafter, taking into account the pending civil litigation, if any, pass appropriate orders on merits and in accordance with the Patta Pass Book Act, 1983. The petitioner may raise all objections before the competent authority, who shall consider them, including those related to the pending civil suits between the petitioner and respondents 5 to 7. The objections shall be recorded and will form part of the record. The said exercise shall be concluded within a period of twelve weeks from the date of receipt of a copy of this order. No costs.

Consequently, the connected miscellaneous petitions are closed.
