2026 Supreme(Online)(Mad) 8409

MADURAI BENCH OF MADRAS HIGH COURT
S. Srimathy, J
MJD Construction and Enginee – Appellant
Versus
The State of Tamilnadu – Respondent
WP Crl.(MD) NO. 576 of 2026 | W.M.P(MD)No. 150 of 2026

Advocates:
For the Appellants/Petitioners: C. Bharathi
For the Respondents: M. Muthu Manikkam, A.S. Abul Kalaam Azad

The court directed administrative authorities to consider representations for the 24x7 transportation of construction materials by applying the logic of previously granted permissions for similar activities.

Headnote:The petitioner sought a Writ of Mandamus to permit the 24x7 transportation of road construction raw materials, including jalli, M-sand, cement, tar, and steel, to worksites and mixing plants in Kanyakumari District. The petitioner contended that existing traffic regulations were causing difficulties in the free transport of materials and the execution of road-laying works. The court examined whether the petitioner's request for the transportation of multiple construction materials should be granted, noting that the District Collector had previously granted permission for the transportation of 'tar' in a similar case. The court reasoned that the current representations should be evaluated in light of that prior administrative decision. With these directions, this Writ petition is disposed of.

Table of Content
1. request for 24x7 transport of construction materials due to traffic restrictions and existing precedents. (Para 1 , 2)
2. direction to authorities to consider representations based on prior administrative orders. (Para 3 , 4)

Prayer:
