A writ appeal is liable to be dismissed if the legal issues raised are identical to those already decided and dismissed by a Division Bench of the same court in related appeals.

Headnote:The appeal was filed under the Letters Patent Act to set aside an order dated 05.03.2024 passed in W.P.No.1925/2016. The matter involves a challenge by the employer against a decision of the Writ Court, which was part of a batch of similar writ petitions. The court identified that the issue raised in the present appeal is identical to those already decided in W.A.Nos.3093 to 3096 of 2025 dated 17.11.2025. The ratio decidendi is that since the legal issue is fully covered by the prior decision of the Division Bench, the present appeal is liable to be dismissed. this writ appeal since also is liable to be dismissed and accordingly, it is dismissed.

Writ Appeal filed under Clause 15 of Letters Patent Act, to set aside the order dated 05.03.2024 passed in WP No.1925/2016 on the file of this Honble Court

Judgment

(Judgment of the Court was delivered by R.Suresh Kumar J.)

1. This intra-court appeal has been directed against the order of the Writ Court dated 05.03.2024 made in W.P.No.1925 of 2016.

2. In fact, a batch of writ petitions had been filed viz., W.P.Nos.1921, 1922, 1923 and 1924 of 2016 and also W.P.No.1925 of 2016.

3. Already, the orders have been passed by the Writ Court in those writ petitions, against which, the present appellant/employer had already moved a batch of writ appeals in W.A.No.3093 to 3096 of 2025, which came to be decided by a Division Bench of this Court dated 17.11.2025 (where one of us is a party) and those writ appeals had been dismissed by confirming the order passed by the Writ Court. Since this is yet another appeal filed against the order passed on 05.03.2024 i.e., on the same date in W.P.No.1925 of 2016 with regard to the very same issue and the impugned order therein dated 05.03.2024

The issue raised in the present appeal is fully covered with the order passed by the Division Bench of this Court made in W.A.Nos.3093 to 3096 of 2025 dated 17.11.2025.

4. In view of the same, this writ appeal since also is liable to be dismissed and accordingly, it is dismissed. However, there shall be no order as to costs. Connected miscellaneous petition is closed.
