Prayer:- Writ Miscellaneous Petition is filed under Article 226 of the Constitution of India, pleased to direct the respondent to reinstate the petitioner or in the alternative to pay the full wages including the last drawn wages of Rs.16,000 /- together with increment and other allowances to the petitioner pending disposal of the above Writ Petition.

ORDER

The application is filed for payment of last drawn wages as per Section

17(B) of the Industrial Disputes Act 1947 and Section 56 of the Industrial Relations Code.

2.On perusal of the affidavit filed in support of the application and records it can be seen that the Writ Petition is filed against an award ordering reinstatement with back wages. The petitioner has filed affidavit that he is not in any gainful employment and the last drawn wages received by him is ₹16,000. Accordingly, so far no counter has been filed on behalf of the learned counsel for the Management. Since the application was filed as early as on 16.09.2025, no further time can also be given. In view thereof, this Writ Miscellaneous petition is allowed on the following terms:-

Since the Writ Petition is filed in the month of September 2024, the last drawn wages shall be paid from the month of September 2024. The arrears of the last drawn wages shall be paid to the petitioner on or before 26.02.2026. In respect of the last drawn wages of every subsequent calender month, the same shall be paid on or before the 10th day of every subsequent month.

3.Post the main Writ Petition for hearing on 03.03.2026.
