O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Certiorarified Mandamus to call for the entire records pertaining to the award passed by the second respondent in Award No.41/2024 dated 15.02.2025 in Na.Ka.A2/590/2023, quash the same and consequently direct the first respondent to consider the petitioner’s representation dated 04.04.2025 with regard to the determination of compensation, strictly in adherence to the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

The grievance of the petitioner is that the petitioner’s properties were acquired for the purpose of handing over the said lands to a private concern to establish a start-up unit for manufacturing solar panels at SIPCOT, Gangaikondam, Tirunelveli District. The impugned award has been passed by the second respondent fixing a lesser amount of compensation. The petitioner submitted a representation dated 04.04.2025 stating that the compensation ought to be determined in accordance with the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

The learned Government Advocate appearing for the respondents would submit that pursuant to the representation made by the petitioner, the Special District Revenue Officer (L.A.), SIPCOT, Tirunelveli, the second respondent herein, had forwarded the award to the Principal District Court, Tirunelveli, since the parties had sought enhancement of compensation.

4. Admittedly, the award was forwarded to the Principal District Court, Tirunelveli. Taking cognizance of the documents received from the second respondent, Special District Revenue Officer (L.A.), SIPCOT, Tirunelveli, the same was numbered as L.A.O.P.Nos.126 and 127 of 2025. In fact, the Principal District Court has also issued notice to the petitioner for his appearance on 01.07.2025. This Court is of the view that since the grievance of the petitioner seeking enhancement of compensation is pending before the Principal District Court, Tirunelveli, the same can be adjudicated by the said Court in L.A.O.P.Nos.126 and 127 of 2025

5. With the above observations, this Writ Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed.
