sealing of the premises of the petitioner in Villa No.5, Saisun Lake View

Villa, Pudupakkam, Kanchipuram – 603 103, sealed by the respondent

Police without any authorization, to enable the petitioner’s daughter to

access her educational material.

O R D E R

The criminal revision petition challenges the order dated

24.12.2025 passed in Crl.M.P. No. 17239 of 2025 by the learned Magistrate,

which permitted the respondent Police to search the premises of the

petitioner.

2. Learned Government Advocate (Crl.Side) would submit

that pursuant to the search, certain documents were seized and the premises

was sealed in the presence of independent witnesses and the respondent

Police have no objection to hand over the keys of the sealed premises to the

petitioner.

3. Learned Senior Counsel for the petitioner would submit

that in view of the stand taken by the respondent Police that they would hand

over the keys of the sealed premises, he would not press for adjudication on

the legality of the seizure and sealing of the premises.

4. In view of the above submissions, the respondent Police

are directed to de-seal the premises and hand over the keys of the premises

in question to the petitioner on or before 11.02.2026. The respondent shall

inform the petitioner the date on which they intend to do so. The petitioner

or his authorised representative shall be present at the time when the

respondent Police propose to de-seal the premises.

5. The learned Government Advocate (Crl.Side) would

further submit that there are 10 other rooms which are to be searched in the

premises and since it was locked, the Police could not search those rooms.

6. The learned Senior Counsel has no objection for the

respondent to conduct a search and seize any property in accordance with

law.

7. The petitioner or his representative shall co-operate with

the respondent and open the portion of the premises, which is locked by him,

for the purpose of conducting a search. The respondent shall complete the

said exercise in one day and it is needless to say that the respondent Police

shall comply with the provisions of Section 105 of BNSS while conducting

the said search.

8. The criminal revision petition stands disposed of with

the above observation.
