The High Court exercised its supervisory jurisdiction under Article 227 of the Constitution of India to direct the trial court to expeditiously dispose of a matrimonial petition where proceedings were unnecessarily delayed during the evidence stage.

PRAYER:

Civil Revision Petition is filed under Article 227 of the Constitution of India, to order to expedite the proceedings before the Trial Court in H.M.O.P.No.54 of 2023 on the file of Principal Sub-Court at Ponneri.

O R D E R

The Civil Revision Petition is filed seeking a direction to the Principal Sub-Court, Ponneri to dispose of H.M.O.P.No.54 of 2023, within a time frame.

2. The petitioner herein filed original petition seeking dissolution of marriage on the ground of cruelty and desertion.

3. A perusal of the e-court status filed in the typed-set of papers would indicate that the counter of the respondent was filed as early as April-2024 and recording of evidence began in June-2025. Though PW.1 was examined in chief and the matter has been continuously adjourned for cross examination of PW.1 for the past six months, without any substantial progress.

4. Taking into consideration the pleadings of the parties were completed and recording of evidence began in June-2025 itself, the Principal Sub-Court, Ponneri is directed to dispose of the original petition in H.M.O.P.No.54 of 2023, as expeditiously as possible.

5. With the above direction, the Civil Revision Petition is disposed of. No costs.
