PRAYER:- Writ Petition filed under Article 226 of the Constitution of

India, to issue a Writ of Mandamus, to direct the respondents to demolish

the damaged Government Hospital Building in Ayakudi Village, Palani

Taluk, Dindigul District and consequently direct the respondents to

construct a new Government hospital building on war foot manner by

considering the petitioner's representation dated 26.12.2022.

ORDER

(Order of the Court was made by DR.G.JAYACHANDRAN, J.)

This writ petition is filed as a public interest litigation seeking

the following relief:

“Writ of Mandamus to direct the respondents to demolish the

damaged Government Hospital Building in Ayakudi Village, Palani

Taluk, Dindigul District and consequently direct the respondents to

construct a new Government hospital building on war foot manner by

considering the petitioner's representation dated 26.12.2022.”

2.Counter affidavit filed by the Joint Director of Health Service

reveals that the old building has been demolished and new construction

is going on in the said place to house the hospital. The relevant

paragraph in the affidavit reads as follows:

“7.It is respectfully submitted that thereafter the

Public works department has declared the building as

Abandoned building. Subsequently the patients were moved out

of the Hospital and thereafter the 4th respondent made a

communication to the Project Director, National Health Mission

vide his letter Na.Ka.No.6630/Theva/2022 dated 31.07.2024

and thereby requested to allot funds for construction of new

Government Hospital Building at Ayakudi. Accordingly, the

above commission vide its letter in Ref No.HSS-

CIVIOOTH/1/2025-CW-NHM-2, dated 14.03.2025 had

accorded Rs.3.50 crores for the Construction of the new

Hospital Building at Ayakudi. Subsequently, tenders have been

called for by the PWD Department and the Government has

approved the Rs.3.50 crores for the construction of the Hospital

by the Government order in G.O(D).No.814 Health and Family

Welfare (F1) Department dated 15.07.2025. Immediately, the

old Building of the Government Hospital has been demolished

on 29.07.2025. Thereafter, the foundation works has been

commenced on 12.08.2025 and now the construction of the new

Hospital Building at Ayakudi is been carried out in a swift

manner.”

3.Recording the same, this writ petition is disposed of.

Consequently, connected miscellaneous petitions are closed. There shall

be no order as to costs.
