PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to rectify the mistakes of the petitioner’s Mother name and his Grandfather name in his Father’s Death Certificate No D-2025:33-16331-00085 dated 08.05.2025 based on the petitioner’s representation letter dated 07.08.2025 within a time frame that may be stipulated by this Court.

ORDER

The writ petition has been filed seeking a mandamus to the respondents to consider the petitioner’s representation dated 07.08.2025, and to direct them to rectify the error in his father's death certificate bearing No.D-2025:33-16331-

000085 dated 08.05.2025.

2. The petitioner's case is that his mother's name and his grandfather's name has been entered wrongly in the death certificate of his deceased father late R.Muniyappan. Hence, the petitioner had submitted a detailed representation on 11.08.2025 along with necessary proof to correct his mother's name as M.Peththammal and his grandfather's name as Rakknnan, in the death certificate of his father issued by the authorities on 08.05.2025. However no action nor an enquiry was conducted on his representation. Therefore, the petitioner had sent a reminder on 07.08.2025. The 4th respondent vide his communication dated 18.09.2025, had informed the petitioner that in order to make any correction / rectification in the death certificate, he must obtain necessary Court orders to that effect. Hence, the petitioner is before this Court.

3. It is brought to the notice of the Court that the petitioner had already filed an appeal before the first respondent challenging the rejection by the authorities to rectify the errors in the death certificate of his father.

4. Heard the learned counsel appearing on both sides and also perused the materials placed before this Court.

It appears that the petitioner had already filed an appeal before the first respondent challenging the rejection to rectify his mother’s name and his grandfather's name in the death certificate of his father. After filing an appeal, the petitioner has filed the above writ petition seeking a mandamus to the respondents to rectify the errors in the death certificate of his deceased father. Considering the fact that the petitioner had already approached the appellate authority for a similar relief now sought in this writ petition, this Court cannot issue a mandamus to the respondents. Hence, the writ petition is dismissed, however, the appellate authority is directed to pass orders within three weeks from the date of receipt of the appeal petition filed by the petitioner, if it is otherwise in order. No costs.
