..Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India for the issuance of Writ of Mandamus, directing the respondents to consider and dispose of the representations dated 11.02.2026 submitted by the petitioner and to forthwith constitute an Ad-Hoc Committee for the limited purpose of administering the religious and charitable activities of Fazeelathunissa Begum Sahiba Mosque during the holy month of Ramzan commencing on 17.02.2026.

ORDER

The writ petition is filed with a prayer to consider and dispose of the representation of the petitioner dated 11.02.2026 and to forthwith constitute an Ad Hoc committee for the limited purpose of administering the religious and charitable activities of Fazeelathunissa Begum Sahiba Mosque during the holy month of Ramzan commencing from 17.02.2026.

Upon hearing the learned counsel for the petitioner and perusing the material records of the case, the grievance of the petitioner is that there is no Muthawalli who is in office as on date in respect of the said Mosque. With reference to some of the members, there are also charges against them. There is no Waqf Board functioning as on date.

In view of the interim order that is granted by the Honourable Division Bench, the petitioner has approached this Court so as to enable the Chief Executive Officer to appoint an ad hoc committee for the limited purpose of administering the religious and charitable activities during the holy month of Ramzan. The arrangements have to be made for Roza and for provision of food and other activities during the month of Ramzan.

4. When the matter came up for hearing, the learned counsel taking notice on behalf of the respondents would submit that now the concerned Waqf is under the direct management of the Waqf Board. The ad hoc committee can be appointed only by the Waqf Board. Therefore, there is no question of appointing any ad hoc committee at present. At the same time, as far as the holy month of Ramzan is concerned, the Superintendent of Waqf / Executive Officer of Waqf will ensure that all the facilities are made and the arrangements for completion of the fast and also special arrangements for all the rituals during the month of Ramzan will be made by the Superintendent of Waqf or Executive Officer himself.

5. I have considered the rival submissions made on either side and perused the material records of the case.

6. Since it is contended that the ad hoc committee has to be appointed only by the Waqf Board and the arrangements will be made by the Executive Officer himself, this writ petition is disposed of on the following terms:

(i) The Executive Officer shall make all arrangements for the religious and charitable activities in respect of the Mosque in question for the month of Ramzan commencing from 17.02.2026.

(ii) For this purpose, it will be open to the Executive Officer to constitute a committee of volunteers from among the list given by the petitioner and also by choosing on his own; however, taking care that none of the controversial members against whom any charge of any nature is pending is not included in that volunteer committee. Let all arrangements be made by including all the persons attending the concerned Waqf in the best interest of celebrating the fest
