ORDER

The present writ petition has been filed seeking a direction to the respondents 1 to 3 to permit the petitioner's son to appear in CBSE XII examination through a Scribe.

2. A perusal of the hall ticket issued by the third respondent reveals that the petitioner's son is having specific learning disability.

3. The learned Counsel appearing for the respondents 1 to 3 submits that petitioner has to obtain the medical certificate from the Civil Surgeon with regard to disability of his son. On production of the said certificate, the second respondent has to consider the said certificate and take a decision with regard to permit the petitioner's son to appear through a Scribe.

4. When the matter came up for hearing on 11.02.2026, it was adjourned to enable the petitioner to get a certificate with regard to medical condition of his son. Accordingly, medical certificate has been issued by the Chief Civil Surgeon to the effect that the petitioner's son is having “mild intellectual disability” and the Principal of the fourth respondent School is also present in the Court. He submits that based upon the permission to be granted by the second and the third respondent, they would permit the students to appear through a Scribe.

5. In view of the above said facts, the second respondent is directed to consider the medical certificate and pass orders permitting the petitioner's son to appear through a Scribe and orders shall be passed on or before 17.02.2026.

6. With the above said observations, this writ petition stands disposed of.

No costs.
