Respondent Petition filed under Article 226 of The Constitution of India praying for the issuance of a writ of certiorarified mandamus to call for the records on the file of the respondent pertaining to the impugned notice dated 08.12.2025 and quash the same as illegal and non-est in law and consequently direct the respondent to release the sale deed dated 31.10.2025 registered as Document No.10539/2025 at the office of the respondent to the petitioner within such time frame as may be stipulated by this Court.

ORDER

The petitioner is the intending purchaser of a property. Upon executing and presenting the sale deed relating thereto, the petitioner received impugned notice dated 08.12.2025.

2. Learned counsel for the petitioner submits that the registering officer does not have the power to determine the additional stamp duty. If he is of the opinion that there was insufficiency, he submits that a reference should be made under Section 47A of the Indian Stamp Act, 1899.

3. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for the sole respondent. He submits that a reference would be made under Section 47A of the Indian Stamp Act unless the petitioner voluntarily pays this amount.

4. Recording the submission of learned Special Government Pleader that a reference would be made under Section 47A of the Indian Stamp Act unless the petitioner accepts the demand and makes payment, this writ petition is disposed of. There shall be no order as to costs.
