O R D E R

(Order of the Court was made by G.K. ILANTHIRAIYAN,J.

This Civil Miscellaneous Appeal has been preferred against the judgment and decree dated 17.10.2024 made in H.M.O.P.No.48 of 2023 on the file of the Family Court, Dindigul, wherein the divorce petition filed by the respondent was allowed.

2. While pending appeal, the appellant and the respondent settled their issues amicably between themselves and entered into a joint memo of compromise on 10.02.2026. Today, both the appellant and the respondent are present before this Court and deposed that the entire issues have been settled between them and they have no objection in disposing of this appeal in terms of the joint memo of compromise dated

10.02.2026, which is extracted hereunder:

“JOINT MEMO FILED BY THE APPELLANT AND THE RESPONDENT

1. The Appellant married the Respondent on

22/05/2013 at Dindigul in accordance with the Hindu Rites and Customs. There is no issue. The marriage is annulled by a decree of Divorce dated 17/10/2024 in H.M.O.P. No. 48 of

2023 on the file of the Family Court, Dindigul.

2. Aggrieved by the decree of Divorce the Appellant/Wife filed the above Civil Miscellaneous Appeal.

3. Without admitting the allegations in H.M.O.P.No.48 of 2023, the Appellant and the Respondent agree for the dissolution of marriage by the said decree of Divorce. Hence, the decree of Divorce in L.M.O.P.No.48 of 2023, dated 17/10/2024, on the file of the Family Court, Dindigul, be confirmed.

4. The Appellant / Wife earlier filed M.C.No.06/2024 for maintenance and that the Hon'ble Family Court, Dindigul, by Order dated 17/10/2024, directed the Respondent to pay a sum of Rs. 3,000/- per month as maintenance.

5. The Appellant/Wife agrees not to press any claim as per the Order of maintenance dated 17/10/2024 passed in M.C.No.06/2024 on the file of the Hon'ble Family Court, Dindigul.

6. In full and final settlement, the Respondent prays the Appellant for a sum of Rs. 20 Lakhs by D.D. No. 253165. The Appellant acknowledges the receipt and acquits the Respondent from all liabilities and payment, either by maintenance or otherwise, forever.

7. The Appellant and Respondent acquit each other against all claims and liabilities and assure that they have no mutual claims or demands between themselves.

8. The Appeal may be disposed of in the above terms.”

3. Hence, this Civil Miscellaneous Appeal is disposed of in terms of the joint memo of compromise dated 10.02.2026 and the joint memo of compromise dated 10.02.2026 shall form a part and parcel of this order. No costs. Consequently, connected miscellaneous petition is closed.
