Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to praying to issue a Writ of Mandamus, directing the respondents 1 to 6 to take action on the encroachers on the basis of the petitioner’s complaint dated 25.11.2024 and forthwith remove the encroachment made in the public roads in Survey No.483/2 and 483/3 gifted to the Government within the Layout bearing Layout No.6/2021 and to restore the free and unhindered access to the plot owners within a time frame to be stipulated by this Court.

The present Writ Petition has been filed seeking to issue a Writ of Mandamus to remove the encroachment in S.Nos.483/2 and 483/3 in Thorapalli Agraharam Village, Hosur Taluk, Krishnagiri District.
2. The learned counsel for the petitioner would submit that there are encroachments in the lands which were already gifted to the Government.
3. At this juncture the learned Special Government Pleader brings to the knowledge of this Court that the petitioner has not impleaded the alleged encroacher. Apart from that, there is a suit pending before the Additional District Judge, Hosur in O.S.No.580 of 2025, filed by the alleged encroacher, in respect of the very same property and that such suit has been filed prior to the filing of the present Writ Petition.
4. Therefore, we are of the firm view that since the alleged encroacher, who is not a party to this Writ Petition has already preferred a suit before the competent civil Court of law for deciding the disputed facts, entertaining a Writ Petition on the very same subject issue is unnecessary.
5. Therefore, granting liberty to the parties to workout their remedy before the civil Court, this Writ Petition is dismissed. No costs.
