Respondent Petition filed under Article 226 of The Constitution of India praying for the issuance of a writ of mandamus directing the respondent to admit the sale deed dated 29.12.2025 for registration within the stipulated time fixed by this Court with liberty to invoke Section 47A(1) of the Stamp Act in case of undervaluation of the property as per the satisfaction of the respondent.

ORDER

Intending to purchase the lands described in paragraph No.2 of the affidavit, the petitioner presented the sale deed dated 29.12.2025 for registration. The petitioner states that the registering officer returned the document without a refusal check slip by orally stating that the property has not been valued properly.

Hence this writ petition.

2. Learned senior counsel for the petitioner submits that the registering officer should have initiated proceedings under Section 47A of the Indian Stamp Act, 1899, if he were of the opinion that the stamp duty has not been correctly paid.

3. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for the sole respondent. He submits that the petitioner may be directed to re-present the document for registration and that the registering officer would either register or issue a speaking order of refusal or make a reference under Section

47A of the Indian Stamp Act.

4. Considering the above submissions, this writ petition is disposed of on the following terms:

4.1 The petitioner shall re-present the document for registration within two weeks from the date of receipt of a copy of this order;

4.2 Within two weeks from such re-

presentation, the registering officer shall register the document or issue a speaking order of refusal or initiate action in terms of Section 47A of the Indian Stamp Act, 1899.

There shall be no order as to costs.
